Terms of Use — TOGETTHERE

By downloading, accessing, or using TOGETTHERE (the "App"), operated by Guilherme Rizzo Carvalhal, an individual (pessoa física) located at Rua Itacema 381, São Paulo, SP, Brazil ("I", "me"), you agree to these Terms of Use. If you do not agree, do not use the App.

1. Acceptance

By tapping "I Agree" or using the App, you accept these Terms and the Privacy Policy. Continued use after updates constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the App.

3. Your Account

You are responsible for your account, the accuracy of your information, and all activity under it. Keep your credentials secure and do not share your account.

4. Acceptable Use

You agree not to: misuse the App or members' data; share anyone's location or personal information without consent; upload unlawful, harmful, or infringing content; attempt to breach security; or use the App for any illegal purpose. I may suspend or terminate accounts that violate these Terms.

5. Location Features (Radar)

The App offers optional live-location sharing among gathering members, which you control. I do not guarantee the accuracy, availability, timeliness, or reliability of location data, routes, ETAs, maps, or AI-generated suggestions. You use location features and rely on any recommendation at your own risk. I am not responsible for any decision, meeting, travel, or action taken based on location data or App content.

6. AI-Generated Content

Suggestions (such as where to eat or what to do) are generated by third-party AI and provided for convenience only. They may be inaccurate, outdated, or unavailable. Verify independently before relying on them.

7. Third-Party Services

The App relies on third-party services (Google Maps/Places, Google Gemini, Base44). I am not responsible for their availability, content, or acts.

8. No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. I DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, I SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP, INCLUDING ANY RELIANCE ON LOCATION DATA OR AI SUGGESTIONS. MY TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED USD 100.

10. Indemnification

You agree to indemnify and hold harmless Guilherme Rizzo Carvalhal from any claim or demand arising from your use of the App, your content, or your violation of these Terms or the rights of any third party.

11. Content Ownership

You retain rights to the content you submit and grant me a limited license to host and display it solely to operate the App. The App's design and code are my intellectual property.

12. Termination

I may suspend or terminate access for any violation of these Terms. You may stop using the App and delete your account at any time.

13. Governing Law & Disputes

These Terms are governed by the laws of the Federative Republic of Brazil. Disputes shall be resolved in the courts of the Foro da Comarca de São Paulo, SP, without regard to conflict-of-law rules.

14. Changes

I may modify these Terms. Material changes will be notified in-app.
